These Terms and Conditions (“Terms”) govern your use of the A Daily Lens mobile application (“App”) and our related website at adailylens.com (collectively, the “Services”).
By accessing or using the Services, you agree to be bound by these Terms and our Privacy Policy. Acceptance of these Terms, the Privacy Policy, age confirmation, and required onboarding consents is necessary to use the App.
If you do not agree to these Terms, do not use the Services.
You must be at least 13 years old to use the Services. By using the Services, you represent that you meet this requirement.
You agree to use the Services only for lawful purposes and in accordance with these Terms. You may not:
A Daily Lens can send daily quote notifications and service-related notifications if you choose to enable notifications. You may change, pause, or disable daily notifications through the App or your device settings.
Although the App allows you to select a preferred notification time, notification delivery and timing cannot be guaranteed. Delivery may be affected by device settings, operating-system behavior, network connectivity, notification services, or other factors beyond our control.
The Services should not be relied upon for time-critical alerts, reminders, or emergency communications.
The A Daily Lens name, logo, App design, website design, graphics, software, and other original materials provided as part of the Services are owned by or licensed to A Daily Lens and may be protected by intellectual property laws.
Quotations and other attributed material presented through the Services may be the work of their respective authors or rights holders. Any rights in such third-party material remain with their respective owners.
You may use content made available through the Services for personal, non-commercial purposes. You may not reproduce, distribute, sell, commercially exploit, or otherwise misuse protected portions of the Services except as permitted by law or with permission from the applicable rights holder.
A Daily Lens may allow users to suggest quotations for possible inclusion in the Services.
When submitting a quote, you should provide an accurate quotation and attribution that you reasonably believe is associated with the identified public figure or source. A Daily Lens may review and independently verify the quotation, attribution, source, appropriateness, and other relevant information before deciding whether to use it.
Submission of a quote does not guarantee that it will be accepted, published, or otherwise used. A Daily Lens may accept, reject, edit, decline to use, or later remove a submitted quote at our sole discretion, including if questions arise regarding its accuracy, attribution, appropriateness, or rights status.
By submitting a quote, you grant A Daily Lens permission to review, store, process, and use the submitted information in connection with the Services. You understand that you will not receive compensation, payment, or credit for suggesting or submitting a quote, even if the quote is later included in the Services.
You should not submit confidential or private information, or material that you know you do not have permission to submit.
The Services are provided for general inspirational and informational purposes only. Content presented through A Daily Lens is not intended to provide medical, mental-health, legal, financial, or other professional advice.
You are responsible for how you choose to interpret and use content provided through the Services.
The Services are provided on an “as is” and “as available” basis. To the maximum extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement.
We do not guarantee that the Services will always be available, uninterrupted, error-free, or completely secure.
To the maximum extent permitted by law, A Daily Lens shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Services.
To the maximum extent permitted by law, if liability is found, our total liability shall not exceed the amount you paid to use the Services, if any, during the twelve (12) months prior to the event giving rise to the claim.
The Services may rely on third-party services or contain links to third-party websites. We are not responsible for the availability, content, privacy practices, or other practices of those third parties.
We may modify, suspend, or discontinue all or part of the Services at any time. We are not liable for any modification, suspension, or discontinuation of the Services to the extent permitted by law.
We may update these Terms from time to time. When we do, we will update the “Last Updated” date above and make the revised Terms available through the App or website.
These Terms are governed by the laws of the State of Vermont, without regard to its conflict-of-law principles.
